ميثاق الشروط والأحكام
المادة 1: القبول والاختصاص
1.1. باستخدامك لخدمات منصة ماركت تريد (Market Trade) أو بوابة الدفع فايت باي (Vite Pay)، فإنك تقر وتوافق بشكل كامل ولا رجعة فيه على الالتزام بجميع البنود الواردة في هذا الميثاق وجميع الوثائق القانونية المرجعية الخاصة بنا.
1.2. الخدمات مقدمة من قبل "شركة أولترا تيك للخدمات المالية المحدودة" (مسجلة في جزر القمر برقم ترخيص: IFSA-2023-345)
1.3. اللغة الإنجليزية هي اللغة الرسمية الوحيدة لهذا العقد. أي ترجمة هي لأغراض إعلامية فقط وليس لها أي قوة قانونية.
المادة 2: طبيعة الخدمات وتحذير المخاطر القصوى
2.1. تقدم المنصة خدمات تقنية تشمل:
- نسخ التداول (Copy Trading): وهي خدمة آلية تتيح لك نسخ صفقات متداولين آخرين. نحن لسنا وسطاء ولا نقدم أي مشورة. نحن مجرد مزود لتقنية الربط، ونجاح أو فشل المتداول المنسوخ ليس تحت سيطرتنا أو مسؤوليتنا.
- التداول خارج البورصة للبيتكوين (BTCUSD OTC Trading): نقدم منصة لعرض طلبات البيع والشراء بين المستخدمين. نحن لسنا طرفًا في أي صفقة ولا نضمن تنفيذها أو شرعية العملة المشفرة المتداولة.
تحذير المخاطر
2.2. تداول الأصول المالية والعملات المشفرة يحمل مخاطر مرتفعة جداً قد تؤدي إلى فقدان كامل رأس المال المستثمر في فترة زمنية قصيرة. الرافعة المالية المتاحة في خدمات النسخ قد تضاعف من خسائرك. أنت تقر بأنك تتحمل هذه المخاطر بشكل كامل وحصري.
المادة 3: مسؤولية المستخدم والامتثال القانوني
3.1. أنت المسؤول الوحيد والكامل عن:
- ضمان أن استخدامك لخدماتنا متوافق تمامًا مع قوانين ولوائح بلد إقامتك وجنسيتك.
- تحديد الوضع القانوني لتداول العملات المشفرة والمنتجات المالية في ولايتك القضائية.
3.2. قائمة الدول المحظورة (المثال التوضيحي): نحظر بشكل صارم الوصول إلى خدمات تداول العملات المشفرة للمقيمين أو المواطنين في الدول التالية (على سبيل المثال لا الحصر):

الإقرار القانوني
3.3. أنت تقر وتعلن بشكل صريح بأن:
- منصة ماركت تريد وشركة فيت باي ليستا مسؤولتين بأي شكل من الأشكال عن أي متابعات قانونية، أو تحقيقات جنائية، أو إجراءات من قبل النيابة العامة، أو أي سلطة حكومية أخرى في بلدك قد تنتج عن قيامك بأنشطة تداول غير مصرح بها أو محظورة بموجب قوانينك المحلية.
- أنت تتحمل وحدك كامل المسؤولية المدنية والجنائية المترتبة على ذلك، وتتعهد بإبراء ذمة الشركتين وحمايتهما من أي دعاوى أو غرامات أو التزامات ناشئة عن أفعالك غير القانونية.
المادة 4: طبيعة خدمات "فايت باي" وحدود مسؤوليتها
4.1. تعريف دور "فايت باي": شركة فايت باي (Vite Pay) هي مجرد وسيط تقني للدفع. مهمتها الوحيدة هي تسهيل عملية نقل الأموال إلكترونياً بينك وبين منصة Market Trade، بناءً على تعليمات الدفع أو السحب التي تصدرها أنت من حسابك.
ما الذي لا تفعله "فايت باي" (تحديد المسؤولية)
4.2. من المهم أن تفهم بوضوح ما يلي:
- لسنا مراقبين: لا نتحقق من مصدر أموالك أو السبب الحقيقي وراء تحويلها. مهمتنا تنفيذ طلب التحويل فقط.
- لسنا مستشارين قانونيين: لا نتحمل مسؤولية التأكد من أن تداولك للعملات الرقمية (مثل البيتكوين) أو استخدامك للمنصة قانوني في بلد إقامتك. أنت المسؤول الوحيد عن معرفة ومراعاة قوانين دولتك.
- لسنا حماةً قانونيين: نحن لن نتدخل ولن نتحمل أي مسؤولية إذا قامت السلطات في بلدك (مثل النيابة العامة، البنك المركزي، أو أية مؤسسة حكومية أخرى) بمحاسبتك أو متابعتك قانونياً بسبب استخدامك لخدمات التداول أو العملات الرقمية، خاصة إذا كنت تقيم في دولة تمنع هذه الأنشطة.
الإقرار الصريح من المستخدم
4.3. باستخدامك لخدمة فايت باي، فإنك تقر وتوافق صراحةً على ما يلي:
- أنك تعلم أن فايت باي لا تقدم سوى خدمة تحويل الأموال.
- أنك تتحمل وحدك كامل العواقب القانونية لأي نشاط تداول تقوم به عبر المنصة، سواء في بلدك أو أي ولاية قضائية أخرى.
- أنك تبرئ ذمة فايت باي وتضمن تعويضها عن أي خسائر أو تكاليف قانونية قد تتعرض لها إذا تمت إحالتك أنت للنيابة العامة أو أي تحقيق قضائي ناتج عن استخدامك للخدمة. ببساطة، مشاكلك القانونية تبقى مسؤوليتك أنت وحدك.
المادة 5: الإقرارات والضمانات
5.1. أنت تقر وتضمن أن:
- أموالك ذات مصدر مشروع تمامًا.
- أنت بالغ سن الرشد القانوني ولديك الأهلية الكاملة للتعاقد.
- جميع المعلومات المقدمة صحيحة ودقيقة.
المادة 6: التحكيم والقانون الحاكم
6.1. يخضع هذا العقد لقوانين جزر القمر.
6.2. أي نزاع ضد Market Trade يُحال إلى التحكيم النهائي والملزم في "مركز جيبوتي للتحكيم الدولي"، وتتكبد أنت كامل مصاريف التحكيم والإجراءات القانونية للطرفين في حالة خسارتك للدعوى.
Terms and Conditions Charter
Article 1: Acceptance and Jurisdiction
1.1. By using the services of the Market Trade platform or the Vite Pay payment gateway, you acknowledge and agree fully and irrevocably to comply with all terms contained in this charter and all our legal reference documents.
1.2. Services are provided by "Ultra Tech Financial Services Limited" (registered in Comoros with license number: IFSA-2023-345) and the subsidiary payment company Vite Pay Limited (registered in Djibouti).
1.3. English is the only official language of this contract. Any translation is for informational purposes only and has no legal force.
Article 2: Nature of Services and Extreme Risk Warning
2.1. The platform provides technical services including:
- Copy Trading: An automated service that allows you to copy the trades of other traders. We are not brokers and do not provide any advice. We are merely a connection technology provider, and the success or failure of the copied trader is not under our control or responsibility.
- Bitcoin OTC Trading (BTCUSD OTC Trading): We provide a platform for displaying buy and sell orders between users. We are not a party to any transaction and do not guarantee its execution or the legitimacy of the traded cryptocurrency.
Risk Warning
2.2. Trading financial assets and cryptocurrencies carries extremely high risks that may lead to complete loss of invested capital in a short period of time. The leverage available in copy trading services may multiply your losses. You acknowledge that you bear these risks completely and exclusively.
Article 3: User Responsibility and Legal Compliance
3.1. You are solely and fully responsible for:
- Ensuring that your use of our services is fully compliant with the laws and regulations of your country of residence and nationality.
- Determining the legal status of cryptocurrency trading and financial products in your jurisdiction.
3.2. List of Prohibited Countries (Illustrative Example): We strictly prohibit access to cryptocurrency trading services for residents or citizens of the following countries (including but not limited to):

Serious Legal Declaration
3.3. You explicitly declare and acknowledge that:
- The Market Trade platform and Vite Pay company are not responsible in any way for any legal proceedings, criminal investigations, or actions by the Public Prosecution, or any other government authority in your country that may result from your unauthorized or prohibited trading activities under your local laws.
- You alone bear full civil and criminal responsibility arising from this, and you undertake to indemnify and protect both companies from any lawsuits, fines, or obligations arising from your illegal actions.
Article 4: Nature of Vite Pay Services and Liability Limitations
4.1. Definition of Vite Pay's Role: Vite Pay is merely a technical payment intermediary. Its sole task is to facilitate the electronic transfer of funds between you and the Market Trade platform, based on payment or withdrawal instructions you issue from your account.
What Vite Pay Does NOT Do (Liability Limitation)
4.2. It is important that you clearly understand the following:
- We are not monitors: We do not verify the source of your funds or the real reason behind their transfer. Our task is only to execute the transfer request.
- We are not legal advisors: We do not bear responsibility for ensuring that your cryptocurrency trading (such as Bitcoin) or use of the platform is legal in your country of residence. You are solely responsible for knowing and observing your country's laws.
- We are not legal protectors: We will not intervene and will not bear any responsibility if authorities in your country (such as the Public Prosecution, Central Bank, or any other government institution) hold you accountable or pursue you legally due to your use of trading services or cryptocurrencies, especially if you reside in a country that prohibits these activities.
Explicit User Declaration
4.3. By using the Vite Pay service, you explicitly acknowledge and agree to the following:
- You know that Vite Pay only provides money transfer services.
- You alone bear the full legal consequences of any trading activity you conduct through the platform, whether in your country or any other jurisdiction.
- You indemnify Vite Pay and guarantee to compensate it for any losses or legal costs it may incur if you are referred to the Public Prosecution or any judicial investigation resulting from your use of the service. Simply put, your legal problems remain your responsibility alone.
Article 5: Declarations and Warranties
5.1. You declare and warrant that:
- Your funds are from completely legitimate sources.
- You are of legal age and have full legal capacity to contract.
- All information provided is true and accurate.
Article 6: Arbitration and Governing Law
6.1. This contract is subject to the laws of the Comoros.
6.2. Any dispute against Market Trade shall be referred to final and binding arbitration at the "Djibouti International Arbitration Center," and you shall bear all arbitration costs and legal proceedings for both parties in case you lose the lawsuit.
